Terms of Service

Welcome to Dirtanian — the app that gets everyone out riding more. These terms are the agreement between you and Dirtanian for using the app, the website and the developer API. Each section opens with the short version, then the full text. By creating an account or using Dirtanian you agree to them, together with our Privacy Policy.

1.Who we are

In short: Dirtanian is a South African company based in Pretoria. Reach us at letsride@dirtanian.com.

Dirtanian is operated by DIRTANIAN (registration number 2026/755674/07), a company registered in South Africa ("we", "us"). We provide the Dirtanian app, the website at dirtanian.com and the developer API at api.dirtanian.com (together, "Dirtanian"). Our address is 141 Lynnwood Road, The Willows, Pretoria, Gauteng 0081, South Africa, our phone is +27 61 503 6596, and our email is letsride@dirtanian.com.

2.Eligibility and your account

In short: You need to be 13 or older, give us true details, and keep your login to yourself. Under-18s ride as a guardian's dependents.

You may hold a Dirtanian account if you are 13 years or older. If you are under 18, a parent or guardian must agree to these terms for you, and you enter events as a dependent they manage. Guardians are responsible for the dependents they add and for the accuracy of their details.

Keep your account details accurate and your password private, and let us know at once if you think someone else has used your account. You are responsible for what happens under your login. We may decline, suspend or close an account that breaks these terms; you can close yours at any time (see the Privacy Policy).

In short: Be the riding mate everyone wants on the trail: respectful, honest and safe.

Dirtanian is for every discipline and every skill level, from a first ride to a podium. To keep it that way, everyone agrees to:

4.Your content

In short: Your rides, photos and posts are yours. You give us permission to show them in Dirtanian so the platform works.

You own the content you add to Dirtanian — rides, posts, photos, comments, polls, reviews and messages. So we can run the platform, you grant Dirtanian a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt (for example, resize or transcode), display and distribute your content within Dirtanian and its features, such as feeds, leaderboards, segments and results, according to the visibility you choose. This licence ends when you delete the content or your account, except for content others have already shared in the ordinary way (such as comments on a post) and results that stay on the record with your name removed.

You confirm you have the rights to whatever you post, and that it follows section 3. We never sell your content or use it in advertising without asking you first.

5.Reporting, blocking and enforcement

In short: Report anything that feels wrong, block anyone you like, and we'll act on it — usually within a day.

Every post, comment, message, photo and profile can be reported from the app, and you can block any rider so that neither of you sees the other's content. We review reports promptly and aim to act on anything that clearly breaks these terms within 24 hours. We may remove content, limit features, or suspend or close accounts that break these terms, repeatedly or seriously. We'll explain what happened and how to put it right wherever we reasonably can. To report something outside the app, email letsride@dirtanian.com.

6.Riding is your call: risk and SOS

In short: Off-road sport has real risks. You ride at your own risk, prepared and within your limits. SOS helps you reach your people — it is not an emergency service.

Off-road sport — motorcycling, mountain biking, 4x4, rally and everything in between — carries an inherent risk of injury, damage and, in rare cases, death. When you use Dirtanian to record, navigate, enter or follow a ride, you accept those risks, confirm you're fit to take part, and agree to ride within your ability, wear appropriate safety gear and follow the rules of the event and the land you're on. Routes, segments, maps and other riders' activities are shared for information; conditions change, and you are responsible for judging what's safe on the day.

The SOS feature sends your location to the emergency contacts you've chosen. It depends on your phone, its battery and network coverage, and it is not an emergency service and does not contact emergency responders. In an emergency, call your local emergency number first.

7.Events, bookings and memberships

In short: When you enter an event, book a venue or join a club, your contract is with the organiser. We're the marketplace that makes it smooth. Refunds follow the organiser's policy and consumer law.

Dirtanian is a platform and marketplace. Event entries, venue and outride bookings, and club memberships are contracts between you and the organiser, venue or club ("the organiser"), who is responsible for the event, its rules, safety, timing and results. We show you the full price before you pay — the price you see is the price you pay. We keep a commission of 10% of the sale (organisers may agree a different rate with us) out of the organiser’s proceeds, and pass on the rest.

Refunds and cancellations are handled by the organiser in line with their event policy, which you'll see before you enter, and the South African Consumer Protection Act (or the consumer law where you live). If an organiser cancels an event, you're entitled to the refund their policy and the law provide. Where you're entitled to a refund, we'll process it through the same payment method.

Organisers, venues and clubs using Dirtanian agree to run their events lawfully and safely, to honour their published policies, and to keep the details riders share with them confidential. These terms are the agreement between us and an organiser until we publish a separate organiser agreement.

8.Photos, payments and payouts

In short: Payments run through Peach Payments. Event photos you buy are yours to keep for personal use. Organisers and photographers are paid out to their verified bank account.

Payments

In-app payments are processed by Peach Payments. Your card details go straight to Peach and never touch our servers. The full total, including every fee, is shown before you pay, and nothing is pre-selected. Items in the Shop are sold and shipped by the merchant through Shopify checkout under Shopify's and the merchant's terms.

Event photos

Photographers and organisers sell event photos through Dirtanian. When you buy one, it's delivered in the app and you receive a perpetual licence to download, keep, print and share it for your personal, non-commercial use. The photographer keeps the copyright. Because a photo is delivered immediately, a purchase is complete once it's downloaded; if a photo is faulty or not what you bought, tell us within 7 days and we’ll put it right or refund you, in full or in part, through the same payment method.

Payouts

Organisers, venues, clubs and photographers are paid out through Peach Payments to their verified bank account, after our commission. Accrued balances settle automatically once a week, on Mondays, and we can release a payout sooner on request. We may ask for identity documents to verify you before the first payout and may hold a payout while a payment is disputed or a refund is due.

9.Advert credits

In short: Advert credits are prepaid service credit for sponsored posts. They're spent on delivery and aren't refundable.

Organisers and partners can buy advert credits to run sponsored posts. Credits are non-refundable prepaid service credit, consumed as your posts are delivered, and have no cash value. Every sponsored post is labelled "Sponsored", must follow the community guidelines in section 3 and applicable advertising law, and may be paused or removed if it doesn't.

10.Developer API

In short: Building on Dirtanian? The API has its own terms at api.dirtanian.com.

Access to the public developer API at api.dirtanian.com is by API key and subject to the API documentation and terms published there, which form part of these terms. The API exposes only riders' public profile information, never private contact details, and you may not use it to re-identify, track or profile riders.

11.What we promise, and what we can't

In short: We work hard to keep Dirtanian accurate and available, but it's provided "as is". Our liability is limited to what you've paid us, except where the law says otherwise.

We provide Dirtanian "as is" and "as available". We don't guarantee that it will be uninterrupted or error-free, or that GPS tracks, segment times, rankings, routes, maps or health data will always be accurate or complete — phones, satellites and networks have their limits. We aren't a party to your contract with an organiser and aren't responsible for events, venues, merchandise or other riders' conduct.

To the fullest extent the law allows, Dirtanian, its team and partners are not liable for indirect or consequential loss, or for loss of data, profit or opportunity, and our total liability to you for anything arising from these terms or your use of Dirtanian is limited to the greater of the platform fees you paid us in the 12 months before the claim and R1,000. Nothing in these terms limits any right you have under the Consumer Protection Act or other law that can't be excluded, including liability for death or personal injury caused by our negligence. Dirtanian's trademarks, wordmark, X mark and app design are ours; please don't use them without permission.

12.Governing law, changes and contact

In short: South African law applies. If we change these terms in a way that matters, we'll tell you in the app first.

These terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction, without taking away any protection the consumer law of your home country gives you. If part of these terms turns out to be unenforceable, the rest still applies.

We may update these terms as Dirtanian grows. We'll post the new version here, update the date at the top, and for material changes let you know in the app or by email before they take effect. Continuing to use Dirtanian after that means you accept the updated terms. Questions? We're at letsride@dirtanian.com. Now go ride.
